What to Make of Executive Order 14398 and the DOJ’s Settlement with IBM

On March 26, 2026, President Trump issued Executive Order 14398, “Addressing DEI Discrimination by Federal Contractors.”  On April 10, 2026, the Department of Justice entered into a settlement agreement with IBM for more than $17 million – the first settlement under the DOJ’s Civil Rights Fraud Initiative. The Administration has moved quickly to implement Executive Order 14398, having already approved contract clauses to be included in both new and existing federal contracts.  

Earlier this year, the Administration also proposed adding new certification language regarding unlawful DEI programs in the System for Award Management (SAM) for entities registering for eligibility for federal financial assistance (i.e., grants).
