What to Expect in 2026—Enforcement Initiatives and New Legal Requirements and Obligations

In this webinar, the attorneys from Roffman Horvitz will discuss the legal landscape for employers in 2026. There will be two main initiatives—one at the federal level and one at the state/local level, which to a significant extent will work at cross purposes from one another.
At the federal level, there will be more active enforcement by the Department of Justice and the Equal Employment Opportunity Commission targeting unlawful DEIA programs. Employers also can anticipate a continuation of pressure campaigns on employers with diversity and inclusion programs by other federal agencies and outside organizations that are aligned with the Trump administration’s attacks on these programs.
At the state and local level, there are and will continue to be new legal requirements going into effect this year. The most active areas will include pay reporting, equity, and transparency; reinforcement of disparate impact liability; and the regulation of the use of artificial intelligence (“AI”) tools in recruiting, hiring, and other employment decisions.
