In the first 10 days of the new administration, President Trump issued several executive orders that created quickly growing pressure, and greatly increased risks, for employers’ workplace Diversity, Equity and Inclusion programs.

Silberman Law is aware of EEOC investigations of DEI programs, initiated in just the past few days, which are based on “Commissioner’s Charges” – meaning there is no complaining party. Instead EEOC, under its new leadership, embarked on these investigations in the absence of employees or former employees alleging anything unlawful about the DEI programs.

Bottom line – employers’ DEI programs now face robust and well-coordinated legal challenges of the type we have not seen before. And we expect those risks to grow, quickly, in the coming weeks and months.
