In this 60-minute Roundtable Masterclass discussing the continued surge in retaliation claims across the country, we have assembled a panel of three top Employment Law attorneys who “have been there and done that” to round out our table discussion with Candee Chambers, Executive Director of DirectEmployers. Greg Keating, from Boston’s Epstein Becker & Green and John C. Fox and Jay J. Wang of Fox, Wang & Morgan in Silicon Valley will join Candee to help employers understand what is currently and rapidly unfolding as to this high-dollar topic.

Greg’s practice has focused on retaliation for decades as he was the first employment defense lawyer to realize the rising threat of the retaliation cause of action. Greg is, as a result, the country’s leading legal expert on the retaliation cause of action and will bring his keen insight and decades of experience with retaliation claims to bear to show employers where the pitfalls are and how plaintiffs’ lawyers are exploiting weaknesses in everyday common HR practices. John will bring some war stories from the courtroom to show how clever plaintiff lawyers can twist otherwise well-intended everyday HR practices to make senior managers seem like they are still crawling out of the caves. The panelists will also offer practical tips as to how companies may take steps to avoid being leveraged by unhappy employees and their counsel.

The Roundtable will first discuss what a retaliation claim looks like these days, the expanding concept of “adverse action,” third party retaliation, retaliatory harassment, and practical best practices to help avoid common pitfalls and/or minimize liability, especially now.
