In this fast-paced 60-minute Employment Law Roundtable Masterclass on Non-Binary Reporting, Data Use and Data Protection, we will discuss how to report the gender of Non-Binary employees on employer EEO-1 forms, considerations and the mechanics of companies choosing to invite Applicants and employees to report genders other than “male” or “female,” and the nomenclature of reporting categories the federal government and the private sector might use on reporting forms.

We will also discuss what companies are doing in fact as to non-binary reporting of genders other than “male”/”female,” how non-binary reporting affects statistical Disparity and Adverse Impact Discrimination Analyses of hires and promotions and also in compensation studies (in or out of the “male” and “female” statistics), and finally, what companies are doing to make Applicants and employees feel comfortable to choose a non-binary reporting code.
