The Equal Employment Opportunity Commission (EEOC) has been very active in the past few months, implementing significant changes and updates to its interpretations of the law and to its priorities as an agency. Among those are:

• A proposal to eliminate the EEO-1 and other reports that track workforce data by sex and race/ethnicity;
• Issuance of a new National Enforcement Plan (NEP) for Fiscal Years 2025-2029, which replaces the Biden-era Strategic Enforcement Plan for 2024-2028
• The solicitation and receipt of an Opinion Letter from the Department of Justice regarding the constitutionality of the EEOC’s interpretation of disparate impact;
• And the proposed rescission of its 1979 guidance regarding voluntary affirmative action plans under Title VII
